Terms & Conditions
These terms apply every time you order from Chappos Avos. Placing an order means you accept them, so it is worth the two minutes it takes to read.
Last updated: 21 September 2026
1. Who you are dealing with
This store is operated by CHAPPOS AVOS PTY LTD (ABN 13 633 006 292), trading as Chappos Avos, a family farm in Brunswick, Western Australia. In these terms, “we”, “us” and “our” mean that company, and “you” means the person placing the order. Contact us any time at info@chapposavos.com.au.
2. Ordering
- You must be at least 18 years old to place an order.
- Your order is an offer to buy. A contract is formed when we confirm your order and take payment — you will receive a confirmation email with an order number and a pickup QR code.
- We may decline or cancel an order if the product is unavailable, if there is an obvious pricing or listing error, or if we reasonably suspect fraud. If we do, we refund you in full.
- Please check your order details before paying. Tell us straight away if something is wrong.
3. Prices and payment
- All prices are in Australian dollars (AUD) and include GST where GST applies.
- The total shown at checkout is what you pay. There are no delivery fees, booking fees, card surcharges or hidden charges.
- Orders are paid in full at the time of ordering, by credit or debit card, Apple Pay or Google Pay, processed by Square. Your card details go directly to Square and are never stored by us.
- Your bank statement will show a charge from Square on behalf of Chappos Avos. If you do not recognise a charge, email us before disputing it — we can usually clear it up the same day.
- Prices can change at any time, but a change never affects an order you have already paid for.
4. No subscriptions or memberships
We do not offer subscriptions, memberships or recurring billing of any kind. Every order is a single, one-off purchase. Your card is charged once, for the amount shown at checkout, and is not stored for future charges.
5. Pickup
We are a pickup-only store — we do not post or courier fruit. You choose a location and a time slot at checkout and collect your order during that window by showing your QR code. Full details, including what happens if a slot changes or you miss one, are in our Pickup & Delivery Policy, which forms part of these terms.
Risk in the goods passes to you when you collect them. Avocados are fresh produce: store them as advised and eat them while they are good.
6. Product descriptions
We describe our fruit as accurately as we can, but avocados are a natural product. Size, shape, colour and ripeness vary between fruit and between seasons, and photographs are indicative rather than exact. Our spray-free and growing claims describe how we farm in Brunswick, Western Australia; we make no claim to any certification we do not hold.
7. Refunds
If something is wrong with your order, our Refunds & Returns Policy applies and forms part of these terms. It sets out when we replace fruit, when we refund, and how long a refund takes.
8. Your personal information
How we handle your name, email, phone number and order history is set out in our Consumer Data Privacy Policy, which forms part of these terms.
9. Using this website
- Give us accurate contact details — if your email or phone number is wrong, we cannot reach you about your order.
- Do not use the site to commit fraud, to interfere with its operation, or to scrape or resell our content.
- Everything on this site — text, photographs, the Chappos Avos name and logo — belongs to us and may not be reproduced commercially without our written permission.
- We may change, suspend or withdraw any part of the site at any time.
10. Liability
Our goods come with consumer guarantees that cannot be excluded under Australian Consumer Law. Nothing in these terms limits those rights.
To the extent the law allows, and other than under those guarantees, our total liability arising from an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss. We do not warrant that the website will be uninterrupted or error free.
Allergies and food safety: our fruit is grown and packed on a working farm. If you have a severe allergy, contact us before ordering.
11. Changes to these terms
We may update these terms from time to time. The version in force for your order is the one published when you placed it. The date at the top of this page shows when the current version took effect.
12. Governing law
These terms are governed by the laws of Western Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Western Australia.
13. Complaints
Email info@chapposavos.com.au. We reply within 2 business days and would much rather fix a problem directly than have you take it anywhere else. If we cannot resolve it, Consumer Protection WA can be reached on 1300 30 40 54.
